TIL a landlord can't just keep your security deposit in Chicago, the calendar is on your side
I was reading the city's rules on the Residential Landlord and Tenant Ordinance and learned that if a landlord doesn't return your deposit or give you a written reason within 45 days, they can owe you double the amount plus court costs. My cousin got $1,400 back from a landlord in Logan Square who sat on his $700 deposit for close to 3 months. You have to send a letter with your new address, though, or you hurt your own case. Has anyone here actually filed for the double damages, and did it go smooth at the Cook County clerk's office?
My buddy went through this in Rogers Park last year. He mailed the letter with the new address by certified mail, which was the move, because the landlord tried to claim he never got it. The clerk's office part was fine, just brought the copies of the letter and the receipt and paid the filing fee. Took a couple months but he got his double back before it ever hit a judge, the landlord's lawyer called and settled fast. The letter is the whole case, honestly.
