Stayed at a bed and breakfast in Vermont, the fireplace had a bird nest two feet up the flue

I went to clear a rental property's chimney near Burlington last Tuesday and found a full robin nest with three eggs sitting on a ledge just above the damper, so I had to wait for hatchlings while the owners panicked, has anyone else dealt with nesting birds mid-season and what did you do about the cleanup fee?
